1. Scope and contracting party

These General Terms and Conditions (T&Cs) apply to all information and services offered via the website cesaraberlin.com. Sales of the products – digital downloads (planners) as well as physical print-on-demand items – take place exclusively via the Etsy platform.

The buyer's contracting party is exclusively CesaraBerlin (Suzana Radtke, see point 2). Etsy merely provides the platform and the payment handling and is not a party to the contract of sale. For purchases via Etsy, Etsy's terms and conditions as well as the CesaraBerlin shop policies stored there apply additionally.

3. Description of services

CesaraBerlin offers digital planners for download as well as physical products (e.g. printed items produced on demand). All products are sold exclusively via the Etsy shop. The website cesaraberlin.com serves to present the brand and the products and to direct interested parties to the Etsy shop.

The pre-contractual mandatory information under Art. 246a § 1 EGBGB (German Introductory Act to the Civil Code) - in particular the identity of the trader, the main characteristics of the product, the total price as well as delivery and service restrictions - is shown in the respective Etsy listing. The contract of sale is concluded exclusively via the Etsy platform.

4. Products, delivery and shipping

Digital products: The digital products are files (e.g. PDF, GoodNotes files) that are made available for download after purchase via Etsy. Since they are not delivered on a physical data carrier, special rules apply regarding the right of withdrawal (see clause 5).

Physical products (print-on-demand): The physical products are printed items that, upon receipt of the order, are produced on demand by external print and shipping service providers and shipped to the delivery address provided by the buyer. Information on shipping costs, delivery areas and expected delivery times is shown in the respective Etsy listing and the Etsy ordering process. For consumers, the risk of accidental loss and accidental deterioration of the goods only passes upon handover of the goods to the consumer (§ 475 (2) in conjunction with § 446 BGB). Statutory warranty rights apply to physical products (§§ 434 ff. BGB); a right of withdrawal applies in accordance with clause 5.

5. Right of withdrawal

Physical products: For the delivery of physical goods, consumers have a statutory right of withdrawal of 14 days from receipt of the goods.

Digital products: For digital content not delivered on a physical data carrier, the right of withdrawal expires when the entrepreneur has begun execution of the contract after the consumer has expressly consented to the entrepreneur beginning execution of the contract before the expiry of the withdrawal period and has confirmed his knowledge that he loses his right of withdrawal upon his consent at the start of execution of the contract (§ 356 (5) BGB / German Civil Code).

Since the sale is processed via Etsy, the withdrawal provisions of Etsy apply additionally.

6. Prices and payment

The prices listed in the Etsy shop are final prices. In accordance with § 19 UStG (German small-business regulation), no VAT is shown. Payment is processed via the payment methods offered by Etsy.

7. Copyright and rights of use

All planners and their designs are protected by copyright. Upon purchase of a digital product, the buyer acquires a simple, non-transferable right of use for personal use. Sharing, reselling or commercial use of the digital files is not permitted without express written authorisation. These usage restrictions apply exclusively to the digital files; for physical products, the buyer's statutory right to resell or pass on the purchased physical item remains unaffected.

8. Liability

Liability for slight negligence is excluded, unless essential contractual obligations, damages from injury to life, body or health or guarantees are affected. This also applies to breaches of duty by vicarious agents.

9. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions remains unaffected.
