Right of Withdrawal

Consumers have the following right of withdrawal

Consumers have a right of withdrawal as set out below, where a consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

Contracting party and sales channels

No contract is concluded via the website cesaraberlin.com itself; the site serves presentation purposes only. Contracts are concluded via the sales platforms Etsy (digital products and physical print-on-demand items) and kasuwa (digital products only).

In both cases your contracting party is exclusively CesaraBerlin (Suzana Radtke). You must therefore always declare your withdrawal to CesaraBerlin - regardless of the platform you ordered from. Which of the following provisions applies to you depends on what you ordered and via which platform; the differences are marked below.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is:

• for the delivery of physical goods, 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods;
• where you ordered several goods in a single order and they are delivered separately, 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good;
• where goods are delivered in several lots or pieces, 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last lot or piece;
• for digital content and services, 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

The following applies in addition to digital content:

If you withdraw from a contract for the supply of digital content not delivered on a tangible medium, you do not owe any compensation for value (§ 357a (3) BGB / German Civil Code). After withdrawal you may no longer use the files provided and may not pass them on to third parties.

For orders placed via Etsy, reimbursement is processed through Etsy's payment system (Etsy Payments). For orders placed via kasuwa, we reimburse you directly ourselves; kasuwa does not process any payments and is not involved in the reversal of the contract.

The following applies in addition to the return of physical goods (relates exclusively to print-on-demand items ordered via Etsy):

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Early expiry of the right of withdrawal for digital content

For a contract for the supply of digital content not delivered on a tangible medium, your right of withdrawal expires early only if all of the following conditions are met:

1. the trader has begun performance of the contract,
2. you have expressly consented to the trader beginning performance of the contract before the expiry of the withdrawal period,
3. you have acknowledged that, by giving this consent, your right of withdrawal expires once performance of the contract begins, and
4. the trader has provided you with a confirmation of the contract pursuant to § 312f BGB on a durable medium.

Orders placed via Etsy

For items listed as digital products, Etsy provides for a separate confirmation regarding the early expiry of the right of withdrawal during the ordering process. Whether this satisfies all of the conditions a) to d) above depends on how Etsy designs its ordering process and its order confirmation; we have no influence over this.

Orders placed via kasuwa

Via kasuwa there is no immediate provision upon conclusion of the contract. Payment is made directly between you and CesaraBerlin; the file is only made available to you after receipt of payment. Until then your 14-day right of withdrawal continues to apply without restriction.

The following applies to both platforms: if even one of the conditions a) to d) above is not met - or if the corresponding declaration is not provided for in the ordering process - your right of withdrawal continues to exist, including after you have downloaded the file.

Notes on the sales platforms

Etsy: For orders placed via Etsy, payment is processed by Etsy (Etsy Payments); reimbursements are therefore handled technically via Etsy. In addition to your statutory rights, Etsy's refund and buyer protection policies are available to you. These do not replace and do not limit your statutory right of withdrawal. kasuwa: kasuwa GmbH (Wieselweg 46, 76228 Karlsruhe, Germany) acts purely as an intermediary and does not process payments. There is no platform buyer protection and no platform refund policy there. You declare your withdrawal directly to CesaraBerlin (address above); we make the reimbursement ourselves. Via kasuwa we offer digital products only and deliver to Germany, Austria and Switzerland; physical goods are available exclusively via Etsy.

Voluntary additional note (not part of the statutory model form): As we sell via two platforms, it helps us to allocate your request if you also state which platform you ordered from (Etsy or kasuwa) and your order number. This information is voluntary and is not a condition for the validity of your withdrawal.
